(1) In the course of investigation by the Commission according to this Act, if any person is found to be involved in a crime related to serious violation of human rights, the Commission shall recommend to the Government of Nepal to take action against such person in accordance with the law.
(2) Notwithstanding anything contained in sub-section (1), the Commission shall not recommend action against the following offenders:-
(a) Reconciled with the victim according to section 22,
(b) Recommended for clemency according to section 26. But if the perpetrator found guilty of more than one crime is not recommended for amnesty in one of the crimes, it will be recommended for action against such perpetrator in the crime that is not recommended.
(3) Notwithstanding anything written in sub-section (1), if the Commission wishes to prosecute the perpetrators found guilty of crimes related to serious violations of human rights before submitting the report as per sub-section (1) of section 27, including in the interim report as per sub-section (2) of section 27 Can make recommendations to the Government of Nepal.
(4) If any person holding a public position is found guilty of a serious violation of human rights by the Commission during the investigation according to this Act, he shall be sent in writing to the concerned authority to take departmental action against him, and if such a letter is received, the authority shall take departmental action against him within three months with appropriate punishment according to the law. The information should be given to the commission.
